Foxit customers agreed to the Foxit End User License Agreement (EULA) when installing the Foxit product. This EULA contained Limited Warranty on Media and No Warranty on Licensed Software (the Warranty section is copied below). Per the Warranty, customers have a period of 15 days to return the defective media on which the Licensed Software
is distributed for a good replacement if they discover a defect in the media during the 30 day period.
LIMITED WARRANTY ON MEDIA
FOXIT warrants that any media on which the Licensed Software is distributed shall be free from material defects for a period of thirty (30) calendar days from the date of receipt of the License. If Licensee discovers a defect in the media during this thirty (30) day period, Licensee may return the defective media to FOXIT within fifteen (15)
calendar days of discovering the defect, and Licensee's sole remedy shall be to have the defective media replaced.
NO WARRANTY ON LICENSED SOFTWARE
THE LICENSED SOFTWARE IS PROVIDED TO LICENSEE "AS IS". FOXIT, AND FOXIT'S LICENSORS AND SUPPLIERS, MAKE NO WARRANTY AS TO ITS USE OR PERFORMANCE. FOXIT, AND FOXIT'S LICENSORS AND SUPPLIERS, MAKE NO REPRESENTATIONS, WARRANTIES, CONDITIONS, OR TERMS (EXPRESS OR IMPLIED, WHETHER BY STATUTE, COMMON LAW, CUSTOM,
USAGE, COURSE OF DEALING, TRADE PRACTICE OR OTHERWISE) AS TO THE LICENSED SOFTWARE, INCLUDING WITHOUT LIMITATION TITLE, NON-INFRINGEMENT OF THIRD PARTY RIGHTS, MERCHANTABILITY, SATISFACTORY QUALITY OR FITNESS FOR ANY PARTICULAR PURPOSE, EXCEPT FOR, AND ONLY TO THE EXTENT THAT, ANY SUCH REPRESENTATION, WARRANTY CONDITION OR TERM MAY NOT BE EXCLUDED OR LIMITED BY APPLICABLE LAW IN LICENSEE'S JURISDICTION.
In rare instances Foxit may, at our discretion, issue a refund if Foxit cannot resolve a substantial issue where the product does not conform to the product's documentation. When Foxit deems a refund is appropriate, the refund paid will be the purchase price minus the order processing and banking fees (5% of the purchase price). In such instances, Foxit requires that purchaser to provide enough information
for us to positively identify the original purchase transaction (e.g., order number, company name, date of transaction, purchase code, number of licenses purchased, etc.).
